Terms of Service

Last updated 22 August 2026

These terms govern your use of LPA Check, a document check service for Lasting Powers of Attorney in England and Wales. By using the service you agree to these terms.

What the service is

LPA Check is a document check. You answer a guided questionnaire about your completed LPA. We check your answers against the Office of the Public Guardian's published requirements and the Lasting Powers of Attorney, Enduring Powers of Attorney and Public Guardian Regulations 2007 (SI 2007/1253). We produce a report listing the issues we identify and classifying the fix for each.

What the service is not

We are not a firm of solicitors and we do not provide legal advice. We are not a government agency and are not affiliated with any government department. We do not assess mental capacity. We are not your certificate provider and cannot act as one. We do not tell you whether the OPG will register your LPA. That decision is the OPG's alone.

Scope of the check

Specifically, we check against: the form version; presentation (pages, single-sided, scale, binding); the original wet-ink document; donor name and date of birth consistency; attorney names and eligibility; appointment type and mixed appointments; replacement attorney wording; LP1H section 5 life-sustaining treatment; people to notify and LP3; certificate provider eligibility; signature order and dating; witness eligibility and details; corrections; sections 12 to 15; the fee and LPA120. We check only what you tell us. We do not verify your answers against the paper document.

Your responsibilities

You remain responsible for your own documents, submissions and decisions. The report is a checklist to help you spot issues. It is not a professional opinion and it is not a substitute for advice from a solicitor or other professional.

The fee

The full report costs £39 for a single LPA, or £59 for both LPAs. The full price is shown before you pay. The OPG registration fee (currently £92 per LPA, £184 for both) is separate and payable to the OPG, not to us. We do not add fees at checkout.

Cancellation

You have a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Because the report is delivered digitally, we ask you at checkout to confirm that you want the service to start immediately and that you will lose your right to cancel once the report is produced. That box is not pre-ticked. If you do not tick it, we will not start the service.

Refunds

Separately from your cancellation right, if you are not happy with your report for any reason, email us within 14 days and we will refund you in full. No questions, no forms. See our Refund page.

Information, not advice

Information on this site is general information about Lasting Powers of Attorney in England and Wales. It is not advice about your circumstances.

Our liability

We are liable to you for failing to carry out the service with reasonable care and skill, as required by section 49 of the Consumer Rights Act 2015. Nothing in these terms excludes or limits that liability. We are not liable to you for any indirect or consequential loss arising from your use of the service or the report. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.

Your statutory rights

Nothing in these terms affects your statutory rights as a consumer.

Regulation

LPA Check is not a firm of solicitors and is not regulated by the Solicitors Regulation Authority or any approved regulator under the Legal Services Act 2007. We are not a government agency and are not affiliated with any government department. We do not provide legal advice. We do not hold professional indemnity insurance.

Because we are not regulated by the SRA, you do not have access to the Legal Ombudsman or the SRA Compensation Fund. Your statutory rights and the small claims process are unaffected. Our complaints procedure is on the Complaints page.
